By participating in this contest, you agree to be bound by the following terms and conditions:
HOW TO PLAY: During June 1, 2010 TO December 31, 2010, register for an account at T 4 Spa Concepts & Designs, LLC (SPONSOR)’s website: www.t4spa.com. No purchase is necessary. A purchase does not increase your chances of winning. Odds of winning depend on the number of eligible participants. Only one entry per participant allowed. Contest expires December 31, 2010. No entries after December 31, 2010 will be accepted. Winners will be selected by random drawing on January 11, 2011. Winners will be notified by email and posted on SPONSOR’s website on January 11, 2011. Only one prize per Winner.
Prize: An iSpa™ pedicure ($4500 value). There are no substitutions, cash or otherwise, for this prize. Random drawing will determine winner. The city, state, and federal taxes as well as shipping and delivery of prizes are the sole responsibility of the Winner.
ELIGIBILITY: No purchase necessary. A purchase does not increase your chances of winning. Open to legal residents of the United States and the District of Columbia (EXCLUDING WITHOUT LIMITATION, RESIDENTS RESIDING IN OR LOCATED IN NEW YORK, FLORIDA, RHODE ISLAND, AN OVERSEAS MILITARY INSTALLATION, PUERTO RICO, OTHER U.S. TERRITORIES OR FOREIGN TERRITORIES) who are 18 years of age or older as of EXP DATE and who have a valid state issued identification prior to EXP DATE. Participant must have a valid email address. One entry per participant. Offer void where prohibited by law, taxed, or otherwise restricted. All federal, state and local laws and regulations apply. Employees of SPONSOR and SPONSOR’s related companies, and the members of such employees’ immediate families are ineligible to participate or win. Entrants are required to provide truthful information and SPONSOR will reject and delete any entry that it discovers to be false or fraudulent. SPONSOR will disqualify any entry from individuals who do not meet the eligibility requirements. If a winner is disqualified for any reason, SPONSOR reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.
INTERNET AND DELIVERY DISCLAIMER: Participants are restricted to the use of ordinary computer equipment and internet access. SPONSOR disclaims all liability for the inability of a participant to complete or continue an online registration due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond SPONSOR's control, or otherwise. SPONSOR disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. SPONSOR is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telecommunication lines, the Internet or at any website or lost or unavailable network connections which may limit an entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. There may be costs associated with the use of computer equipment and internet access; participant is solely responsible for these costs. There may be costs associated with the shipping and delivery of prize; winner of prize is solely responsible for these costs.
PUBLICITY; USE OF PERSONAL INFORMATION: By participating, all participants and winner(s) grant SPONSOR exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, participants agree that SPONSOR may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
RELEASE: By participating in the Contest, each participant and winner waives any and all claims of liability against SPONSOR, its related companies and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by SPONSOR.
TAXES: The value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize, which is not specifically provided for in the official rules. Each winner must provide SPONSOR with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
DECISIONS: By participating in the Contest, participants agree to be bound by the decisions of SPONSOR personnel. SPONSOR reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who SPONSOR believes has violated any rule, gained unfair advantage in participating in the Contest, or obtained winner status using fraudulent means. SPONSOR will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of SPONSOR, SPONSOR reserves the right to terminate this Contest, or make such other decisions regarding the outcome as SPONSOR deems appropriate. All decisions will be made by SPONSOR are final. SPONSOR may waive any of these rules in its sole discretion.
MISCELLENOUS: Each winner must submit proof of eligibility and sign SPONSOR's release form to claim the prize. No purchase necessary to participate or win. Purchase does not increase chance of winning. Void where prohibited. Odds of winning depend upon the number of eligible participants.
SPONSOR disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. SPONSOR reserves the right to change or amend these rules at any time without prior notice. Louisiana law will govern the interpretation of this agreement, and any legal action involving SPONSOR will be heard in Louisiana state court sitting in Baton Rouge, LA.
